Enforcing Net Neutrality: A continuous monitoring challenge

New Delhi, 20thJuly, 2015- The Indian Legal Foundation (TILF) in association with Grandmasters India conducted a Brainstorming and Forum Discussion in India Habitat Center, Lodhi Road, New Delhi. This day-long session focused on the various aspects of Net Neutrality.

As the Department of Telecom (DoT) panel lead by Shri A.K. Bhargava released its report on Net Neutrality, there still remained concerns among the Free Internet proponents about the enforcement of Principles of Net Neutrality.  The DoT panel suggestions on enforcing Net Neutrality included enacting a law, amending Licensing Conditions, creating a DoT monitoring cell and also creating training institutions to monitor Net Neutrality violations. However, all of these seem to be soft approaches for bigger violations that impact Principles of Net Neutrality.  There seems to be no recommendations on quantum of penalty or punishments in case of deliberate violations on Net Neutrality.  

These were some of the concerns aired during well attended Think Tank Meeting with participants from Corporates, Government, Politics, NGOs and Startups.  “While we appreciate the overall intent of DoT report, but where does it talk about penalties, like we saw in the recent AT & T case in United States” asked Renu Jha, Chairperson, Government Affairs, The Indian Legal Foundation (“TILF”) - a New Delhi based Think Tank organization. Renu further mentioned, “We need to create a regulatory body with powers to impose fine and punishments. It is a necessary step towards creating and regulating Net Neutrality in India”

While welcoming DoT recommendations, Mr. Rajendra Sharma, General Counsel, Samsung said “That there still needs to be a lot of work in creating an appropriate legislation around the governance of Internet in India. We need to incorporate best practices from EU and United States to ensure freedom of Internet in India”.

The Think Tank Event was presided over by Shri Tarun Vijay, Member of Parliament, Rajya Sabha who is among the most vocal proponents of Free Internet in India and has equated net neutrality to Human Rights of Digital Age. “Net Neutrality is core and essential to the government program on Skill Development, Digital India and Make In India. Government and Indian parliament is committed to Net Neutrality. Any apprehension on recent DOT recommendation will be debated and government will fight for democracy of Internet” said Shri Tarun Vijay.


The event was also marked by number of startups concerned about their growth in case Telcos are allowed to disseminate discriminatory tariffs or bandwidth to users. “Will it not be a classic case of crony capitalism if startup applications are discriminated as they are unable to cuff up extra bug for Telcos” asked Yogesh Kochar, a social media start up for school students in India.  Renu agreeing with young startup entrepreneurs stated, “India is hub of startups for quality software and mobile applications. Any pricing or accessibility discrimination against newer applications by Telcos will certainly kill their growth and stifle innovation”.
The Government’s hypothesis needs to be supported – “Good” regulations are better than “No” regulations at all. We do not want Indian Government or DoT to be silent on this important subject. If they remain silent and do not positively support Net Neutrality, ISPs on a later date can disrupt access to websites that do not pay them or compete with their interests. Indeed, the survival of Internet depends on DoT and Government of India and it’s implementation and enforcement of principles of Net Neutrality.

Govt extends Full Mobile Number Portability by Two Months

Govt extends Full Mobile Number Portability by Two Months
The Government has approved recommendations of TRAI on Full Mobile Number Portability (MNP) on 3rd November, 2014. The same was to be implemented within a period of 6 months.

Various steps were taken for implementation of Full MNP. TRAI has also issued a regulation on 25th February, 2015 for the same. This regulation prescribed the elaborated process/steps for implementation of Full MNP in actual scenario when the number is to be ported. Detailed discussions were held with stakeholders to address various technical complexities emerged while implementing the Full MNP in the networks.

The various operators have already put in place hardware and software in their system required for implementation of Full MNP. Internal testing by these operators is in advanced stage. The detailed final testing is schedule to commence shortly and is likely to be completed in two months for most of the operators. 

In view of above, the Government has decided to extend the date of implementation of the full MNP in the networks by two months. --PIB

Deal marks India’s first dual band, dual carrier 3G implementation
 

New Delhi, India – Nokia Networks today announced that it has bagged a 3G contract from Bharti Airtel that will help Airtel enhance its 3G network in the Mumbai, West Bengal and Bihar telecom circles* using Nokia’s latest Single RAN (radio access network) Advanced platform. The deal includes an India-first dual band, dual carrier 3G network implementation, refarming 900 MHz to complement Mumbai’s existing 3G network on 2100 MHz. This will enable higher throughput and thus improved 3G services for Bharti Airtel’s customers.

Abhay Savargaonkar, Director Network Services Group, Bharti Airtel said, “As a brand committed to enrich lives, we continue to offer innovative data services like One Touch Internet, Re 1 entertainment store et al empowering millions across the country to leverage the power of mobile internet on our smartphone network. The association with Nokia is in line with this and will enable millions of customers to experience an enhanced 3G network in these circles.”

Under the contract, Nokia Networks will supply its Single RAN Advanced platform, based on its energy-efficient Flexi Multiradio 10 Base Station**. This multi-standard radio platform is optimal because it will also support Bharti Airtel in its TD-LTE rollout and pave the way to FDD-LTE in the near future. In addition, Nokia Networks will deploy its Flexi Lite Base Station, a small all-in-one base station optimized for indoor and outdoor micro-cell deployments to provide the best coverage in densely crowded areas. Nokia will also supply its extremely compact, highly scalable and flexible multi-technology, all-IP multicontroller RNC (mcRNC).

Nokia’s NetAct network management system will enable effective monitoring and management of Bharti Airtel’s networks. Nokia Networks will also provide a range of services such as network planning and optimization, network implementation, network operations, and care services including hardware and software maintenance as well as competence development.

LAVA International Limited as per Cybex Exim data imported a total of 5.3 million feature phones in this time frame putting it at No. 1 slot as compared to other Indian handset manufactures including Karbonn with 4.6 mn & Micromax at 5 mn shipments.

The data also highlights that in the second Quarter of 2014, Lava International Limited (Lava & Xolo combined) imported a total of 7.27 mn handsets in India, 13% more than the 3rd largest player.

The Chief Minister Naveen Patnaik has distributed mobile phones to 5000 farmers on Tuesday. The distribution of mobiles to farmers was aimed to avail them the facility of getting information about cultivation.

The opposition has criticized the move of the state government. According to media reports, the farmers in the state could get sms over agriculture in their regional language, which would be make them aware about the cultivation techniques.

In the age of hi-tech, why the farmers of the Odisha state to stand behind and the measure to provide them mobile device should praised. It is noteworthy that the state was already having many mobile subscribers and the free distribution of mobile could make the figure go up further.

The state government has planned to distribute 20,000 mobile phones to farmers and those would be cost around Rs1,000 per device.

WeChat has also introduced “Official Accounts” on its platform, a feature that can be utilized by companies and merchants to build interactivity with their fans in a new and innovative way. Leading brands like Café Coffee Day, Big Bazaar, Yahoo! Cricket, Goibibo, Santa Banta, and Tradus are amongst the earliest brands to start their Official Accounts on WeChat in India.

The global top free mobile social communication application WeChat, was launched in India in July last year across iPhone, Android, Symbian, and Windows Phone platforms and was recently launched on the BlackBerry platform as well.

WhatsApp bigger than Twitter: CEO Jan Koum

Company founder and CEO Jan Koum said that Messaging app “WhatsApp” now has more users than Twitter.

He also said that WhatsApp has more than 200 million monthly active users; these users are generating an average of 8 billion inbound messages and 12 billion outbound messages per day.

WhatsApp Messenger is available for iPhone, Android, BlackBerry and Nokia, this messenger allows users to exchange messages without having to pay for SMS. Since its founding in 2009, it has been providing free service. But WhatsApp is slowly phasing an annual fee of 99 cents.

CEO Jan Koum said "Our goal is to build a sustainable, independent company. We want to build a business, and mobile and messaging is the only thing we do “and ruled-out leaving WhatsApp's policy against running ads.

Airtel launches 4G services in Chandigarh, Mohali & Panchkula

The company has launched its 4G LTE services in Kolkata, Bengaluru, Pune and now Chandigarh, and is currently working towards rolling out state-of-the-art networks in remaining license circles.
